Terms of sale

1. Purpose
These terms of sale govern purchases made with Pâtisserie Agathe Olivet (TEVILO): orders for pastries, bespoke creations, enrolment in pastry workshops and gift cards. Any order or enrolment implies full and unreserved acceptance of these terms.
This website does not sell online: order, booking and enrolment forms are requests, subsequently confirmed by the house; payment is made in-store. Only gift cards and vouchers may, where applicable, be paid for remotely (article 6).
2. The seller
TEVILO, EURL (entreprise unipersonnelle à responsabilité limitée) with a share capital of 1 000 €, registered at Centre commercial Le Boulidou, Place du Boulidou, 34980 Saint-Clément-de-Rivière, SIREN 952 091 452 (952 091 452 R.C.S. 3. Prices
All prices are quoted in euros, inclusive of VAT. Bespoke creations are subject to a prior written quote. Prices may vary according to season and availability; the applicable price is that in force at the time the order or enrolment is confirmed.
4. Pastry orders
Orders from the seasonal menu must be placed at least 48 hours in advance (any order placed after noon counts as the following day). Bespoke creations (wedding cakes, choux pastry towers, number & letter cakes, etc.) are made to quote, with a minimum lead time of 72 hours after agreement. The order is firm once confirmed by the house. A deposit may be requested for substantial creations; it is non-refundable if the customer cancels less than 48 hours before the agreed collection date (72 hours for bespoke creations).
Collection is exclusively in-store, on the agreed date and at the agreed pickup slot. No delivery is offered. Transport and storage advice is given at the time of collection.
5. Pastry workshops
Enrolment in a workshop is done online, without immediate payment. Each workshop requires a minimum number of participants: it is confirmed once that number is reached. Payment is only requested upon confirmation. If the required number is not reached, the workshop does not go ahead: we will then offer you alternative dates with no commitment or charge on your part.
Once a workshop has been confirmed and paid for: if you are unable to attend, you may send someone in your place or transfer your place to another session provided you give us at least 7 days' notice before the date. Within that period, or in the event of a no-show, the full fee remains due. Should the house have to cancel a confirmed session, you would be fully refunded or rebooked, at your choice.
As this is a leisure service provided on a specified date (Article L221-28, 12° of the French Consumer Code), the 14-day withdrawal right does not apply to workshops.
6. Gift cards & vouchers
Gift cards and vouchers are valid for 12 months from their date of issue, redeemable in one or several instalments against creations and workshops offered by the house, in-store. The validity period and expiry date are communicated to the buyer before purchase and shown on the card or voucher itself. They are personalised or bearer instruments according to your choice, are not reloadable, cannot be refunded or exchanged for cash, and are not replaced in the event of loss or theft. Any unused balance at expiry is forfeited.
Where a gift card or voucher is paid for remotely, the buyer benefits from the right of withdrawal described in article 8.
7. Payment
Payment is made in-store at collection, or by any secure method indicated by the house upon confirmation (payment link, bank transfer). No card data is collected or stored by this website.
8. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to perishable goods (pastries), goods made to specification (bespoke creations), or leisure services provided on a specified date (workshops).
Gift cards and vouchers paid for remotely: in accordance with Articles L221-18 et seq. of the French Consumer Code, the buyer has 14 days from receipt of the card or voucher to withdraw, without giving any reason, by simple e-mail to contact@agathe-olivet.com, and will then be fully refunded. A card or voucher that has been used, even partially, can no longer be withdrawn from.
9. Statutory warranties
Independently of any commercial guarantee, the customer benefits from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Under the statutory warranty of conformity, the customer may obtain the replacement of a non-conforming item or, failing that, a price reduction or the cancellation of the sale, free of charge. Given the perishable nature of pastries, any lack of conformity should be reported as early as possible, ideally at collection.
10. Complaints & mediation
Any complaint may be sent to contact@agathe-olivet.com. In accordance with Articles L612-1 et seq. of the French Consumer Code, the customer may refer a dispute free of charge to a consumer mediator with a view to an amicable settlement (mediator’s contact details to be provided by the house).

12. Governing law
These terms of sale are governed by French law. In the absence of an amicable resolution, any dispute shall fall within the jurisdiction of the competent courts.
